Licensing Arrangement prior to the Commencement of the Firearms and Ammunition (Declaration of Arms) (Amendment) Regulation 2021

     Firearms and Ammunition (Declaration of Arms) (Amendment) Regulation 2021 (Amendment Regulation) will come into effect on November 1, 2021.  Upon commencement of the Amendment Regulation, specific firearm component parts, i.e. barrel, chamber, cylinder, a frame, body, receiver, a breech block, bolt or other mechanism for containing the pressure of discharge at the rear of a chamber, will be within the definition of “arms” under the Firearms and Ammunition Ordinance (Cap. 238).

     If anyone is in possession of any firearm component part(s) before the Amendment Regulation comes into effect, he/she is required to submit his/her application to the Commissioner of Police on or before October 31, 2021.  If anyone wishes to dispose of the firearm component part(s), he/she may authorise the Commissioner of Police to receive and dispose of the firearm component part(s) or transfer the same to a licensed arms dealer, shooting club or individual.  Details have been uploaded to the webpage of Police Licensing Office: (https://www.police.gov.hk/ppp_en/11_useful_info/licences/arms.html).

     If anyone fails to do so prior to the commencement of the Amendment Regulation, he/she may commit the offence of “Possession of Arms or Ammunition without Licence” under the Firearms and Ammunition Ordinance (Cap. 238), and shall be liable on conviction upon indictment to a fine at level 6 ($100,000) and to imprisonment for 14 years.
